IL HB3010

Amends the Criminal Identification Act to add Section 5-6-3.4 creating "Second Chance Probation" for first-time felony offenders convicted of specified non-violent crimes including drug possession, theft, retail theft, criminal damage to property, and cannabis possession.

Allows courts to sentence eligible defendants to probation without entering a judgment, with mandatory conditions including employment, education/GED completion, restitution, drug testing, community service, and fines, with probation period of at least 24 months.

Exempts defendants from Second Chance Probation if they have prior felony convictions or adjudications for violent offenses, or if the current offense involves violence, sexual conduct, domestic violence, driving under the influence, or firearm possession.

Upon successful completion of probation conditions, the court must discharge the defendant and dismiss proceedings; discharge is not considered a conviction for purposes of law disqualifications but remains admissible as evidence in aggravation if defendant commits another offense within 5 years.

Limits Second Chance Probation to one discharge and dismissal per person across multiple drug and probation statutes; updates cross-references in Cannabis Control Act, Illinois Controlled Substances Act, and Methamphetamine Control Act to include the new probation option.
