IL HB3128

Amends the Illinois Parentage Act to prohibit custody or visitation rights for men who father children through sexual assault or sexual abuse.

Applies to persons convicted of or who pled guilty to sexual assault, aggravated sexual assault, predatory sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse under Illinois Criminal Code.

Also applies to persons found by clear and convincing evidence at a fact-finding hearing to have committed non-consensual sexual penetration in fathering the child.

Requires consent from the child's mother or guardian for any custody or visitation; prohibits the father or his relatives from seeking custody or visitation without such consent.

Maintains the father's child support obligations unless the mother or guardian declines them, but denies the father inheritance rights or other succession benefits from the child without consent of the mother or guardian.
