IL HB3147

Allows minors age 13 or older to file motions to reinstate parental rights, in addition to the Department of Children and Family Services.

Requires more than 3 years to have passed since parental rights were terminated, surrendered, or a guardian with adoption consent powers was appointed.

Mandates court findings supported by clear and convincing evidence that reinstatement is in the minor's best interest and meets conditions including the minor not being in a placement likely to achieve permanency.

Requires the Department of Children and Family Services to conduct an assessment of circumstances for children over 13 who meet reinstatement criteria to determine appropriateness of filing such a motion.

Voids any previous guardianship appointment with adoption consent powers and any adoption consents upon entry of an order granting parental rights reinstatement.
