HB3202 Summary

• Requires all Illinois law enforcement agencies to install in-car video camera recording equipment in all patrol vehicles by July 1, 2014, with recording capability of at least 10 hours.

• Mandates video and audio recording of enforcement stops, including traffic stops, pedestrian stops, and motorist assists, with recording beginning when officer determines a stop is necessary and continuing until the action is completed.

• Requires recording of field sobriety tests, portable breath tests, and the 20-minute observation period before breath testing in suspected DUI cases (violation of 625 ILCS 5/11-501).

• Establishes that recordings must be retained for at least 90 days, or longer if related to arrests or criminal proceedings, and prohibits alteration or erasure before the retention period expires.

• Adds exemptions to Illinois eavesdropping laws for audio/video recordings made simultaneously with in-car video cameras during enforcement stops or when emergency lights are activated, and recordings made in police vehicles.
