IL HB3216

Amends the Criminal Code of 2012 to classify streetgangs that regularly engage in streetgang-related activity as a public nuisance, defined as activity occurring at least 5 times within a 12-month period.

Creates criminal liability for knowingly maintaining a streetgang public nuisance, punishable as a Class A misdemeanor for the first offense and a Class 4 felony for subsequent offenses.

Allows any person who regularly associates with others to engage in criminal streetgang activity to be named as a defendant in civil actions to abate the public nuisance.

Permits the State's Attorney to bring abatement actions against streetgang properties and individuals engaged in criminal streetgang activity.

Grants injured parties the right to recover three times actual damages plus punitive damages and attorney's fees from those responsible for streetgang-related activity.
