HB3319 Summary

• Amends the Environmental Protection Act to modify requirements for landscape waste composting operations on farms, allowing certain operations to proceed without permits under specified conditions.

• Permits farm-based composting facilities that accept agricultural materials from other operations if they meet acreage limits (no more than 2% of farm property), distance requirements from residences and water supplies, and other environmental safeguards.

• Allows composting facilities to accept crop residue, agricultural plant residue, and plant-derived animal bedding from other agricultural operations, with composting additives limited to 10% of total material.

• Requires annual registration and reporting to the Agency on composting volumes and certification of compliance with setback distances from wells (200 feet), floodplains, residences (1/4 mile unless local ordinance approves lesser distance), and water table (5 feet).

• Takes effect upon becoming law.
