HB 4089 Amendment Summary

• Amends Section 3-6 of the Criminal Code of 2012 regarding extended statutes of limitations for various criminal offenses.

• Extends prosecution period for sexual crimes against minors: allows prosecution at any time when corroborating physical evidence is available, or within 20 years after the victim turns 18 for felony sexual offenses, and within 10 years for misdemeanor sexual abuse.

• Changes statute of limitations for criminal sexual assault and related offenses from 10 years to 20 years after commission of the offense when corroborating physical evidence is not available.

• Adds extended 7-year limitation period for theft of real property exceeding $100,000, identity theft, aggravated identity theft, and certain financial crimes under Articles 16H and Section 17-10.6.

• Maintains existing extended limitation periods for fiduciary theft (1 year discovery plus 3-year cap), public official misconduct (1 year discovery plus 3-year cap), and trafficking/servitude offenses involving minors.
