IL HB4204

Establishes the Office of the Condominium and Common Interest Community Ombudsperson within the Department of Financial and Professional Regulation to provide education, training, and dispute resolution assistance for condominium and common interest community associations.

Requires all condominium and common interest community associations to adopt a written complaint resolution policy by 180 days after the effective date (July 1, 2016) that includes a complaint form, delivery process, timeline for response, and written final determinations marked as "final."

Permits unit owners to request ombudsperson assistance beginning July 1, 2019 for disputes involving violations of condominium or common interest community property laws, provided they have exhausted the association's internal complaint process, owe no outstanding assessments unless central to the dispute, and file within 30 days of receiving a final adverse decision.

Requires all associations to register with the Department on a biennial basis, providing business information, management details, complaint policies, and declaration recording information; unregistered associations lose authority to impose or enforce liens for common expenses.

Requires the Department to submit annual reports to the General Assembly beginning October 1, 2020, analyzing workload data and the most common dispute types to inform potential statutory reforms; the act sunsets July 1, 2021.
