IL HB4236

Amends the Alcoholism and Other Drug Abuse and Dependency Act to add Section 12-7.3 of the Criminal Code of 2012 to the list of crimes that disqualify individuals from electing treatment as an alternative to prosecution.

Individuals charged with or convicted of crimes related to drug or alcohol abuse may elect supervised treatment through a designated program, subject to specified exceptions.

Adds stalking offenses (Section 12-7.3) to existing exclusions that already include crimes of violence, controlled substance violations, and certain cannabis and methamphetamine offenses.

Maintains existing restrictions on treatment eligibility including prior violent crime convictions, pending felony charges, probation/parole status, and previous program admissions within 2-year periods.
