IL HB4320

Adds Section 11-46 to the Criminal Code of 2012 creating a new offense of sexual exploitation via non-consensual dissemination of a sexual act or intimate parts.

Prohibits intentionally disseminating images of identifiable persons at least 18 years old engaged in sexual acts or showing intimate parts when obtained under circumstances indicating privacy expectations and without consent.

Exempts disseminations made during criminal investigations, for reporting unlawful conduct, involving voluntary public exposure, or serving a lawful public purpose.

Classifies the offense as a Class 3 felony subject to forfeiture provisions under Article 124B of the Code of Criminal Procedure.

Amends forfeiture statutes to include violations of Section 11-46 among offenses triggering mandatory forfeiture of profits, proceeds, and property acquired through the criminal conduct.
