Adds Section 52 to the Radon Industry Licensing Act granting the Agency's Assistant Director or designee power to subpoena witnesses and compel production of books, papers, and records relevant to radon-related administrative proceedings or investigations.

Witness fees for attendance and travel are set at the same rates as witnesses before circuit court in the county where the hearing is held, payable when the witness is excused from further attendance.

When the Agency subpoenas a witness, the Agency pays fees as administrative expenses; when another party requests a subpoena, that party may be required to pay service and witness fees, with the Agency able to require a deposit to cover costs.

Subpoenas may be served using standard circuit court procedures or by United States registered or certified mail, with the Agency required to adopt rules for challenging subpoenas.

If a person fails to appear, answer questions, or produce documents in response to a subpoena, the Agency may seek enforcement through the Attorney General in any circuit court in the State.
