Prohibits operating a motor vehicle on a roadway while using an electronic communication device, defined as hand-held wireless telephones, personal digital assistants, and portable computers, but excludes integrated vehicle systems and GPS devices.

Establishes escalating fines for violations: $75 maximum for first offense, $100 for second, $125 for third, and $150 for fourth or subsequent offense.

Creates "aggravated use" offense when electronic device use causes a motor vehicle accident resulting in great bodily harm, permanent disability, disfigurement, or death to another person, classified as a Class A misdemeanor.

Elevates aggravated use resulting in death to a Class 2 felony, with mandatory minimum 480 hours of community service if the offender receives probation or conditional discharge.

Provides exemptions for law enforcement, emergency vehicles, hands-free or voice-operated modes, emergency reporting, commercial vehicle communication devices (10" x 10" maximum screen), parked vehicles, stopped traffic with transmission in neutral or park, and certain two-way radio services.
