A second violation of fleeing or attempting to elude a peace officer becomes a Class 4 felony (changed from third violation).

A first violation of aggravated fleeing or attempting to elude a peace officer increases from a Class 4 felony to a Class 3 felony.

A second or subsequent violation of aggravated fleeing or attempting to elude a peace officer increases from a Class 3 felony to a Class 2 felony.

Aggravated fleeing includes flight at speeds 21+ mph over the legal limit, causing bodily injury, property damage exceeding $300, disobeying 2+ traffic control devices, or concealing/altering vehicle registration plates.
