IL HB5302

Creates new offense of drug-induced homicide of an unborn child under Illinois Criminal Code (720 ILCS 5/9-3.3-1).

Defines "unborn child" as any individual of the human species from fertilization until birth.

Offense occurs when a person unlawfully delivers a controlled substance to a pregnant woman or ingests/injects/inhales/absorbs a controlled substance, and the unborn child's death results from that substance.

Violation is a Class X felony, with mandatory sentence of 15-30 years imprisonment or extended term of 30-60 years for violations involving specific subsections of the Illinois Controlled Substances Act or Methamphetamine Control and Community Protection Act.

Effective immediately upon becoming law.
