HB5625 - Access to Cemeteries on Private Property Act

• Private property owners must allow ingress and egress to cemeteries or graves on their land to family members/descendants of buried persons and cemetery plot owners upon receipt of written notice.

• Property owners must respond within 30 days of receiving notice with a written proposal designating reasonable conditions for access, including routes, duration, and time restrictions.

• Landowners cannot erect walls, fences, or structures blocking cemetery access unless they include a gate or means of access, and may designate frequency, hours, and access routes.

• Access is limited to visiting graves and maintaining gravesites; motor vehicle access is prohibited unless a road or right-of-way exists and the owner grants written permission.

• Landowners are immune from civil liability for injuries or damage arising from granted access except in cases of gross negligence or willful misconduct; visitors are liable for any damage they cause to the property.
