Solid Waste Hauling and Recycling Program Act (HB5666)

• Requires all waste haulers operating in counties with 3,000,000+ population (and contiguous counties) to offer recyclable material collection services to commercial businesses, commercial properties, and institutional facilities either as basic or additional service.

• Mandates haulers provide recycling information to customers at least every other year and make written offers to non-recycling customers at least once every 2 years or during contract term, whichever is shorter.

• Prohibits haulers from depositing collected recyclable materials into landfills or incinerators unless all reasonable efforts to sell materials to processors or end users have been made.

• Establishes reporting requirements for municipalities with less than 1,000,000 population that have never awarded waste collection franchises, requiring licensed haulers to report semi-annually on non-residential locations served and recycling participation rates for 36 months before a franchise can be awarded.

• Restricts municipalities from awarding their first non-residential waste collection franchise unless less than 50% of non-residential locations contract for recycling services, and requires public hearings and at least 30 days' notice before issuing franchise requests or awarding franchises.
