HB5700 Summary

• Changes "may" to "shall" for confining persons 18 years of age and older with delinquency petitions filed against them in adult detention facilities.

• Prohibits persons 18 years of age or older who have been adjudicated delinquent minors and violated juvenile parole or aftercare release terms from being confined in juvenile detention facilities.

• Removes discretionary factors (age, prior history, abuse/neglect history, mental health/educational history) that courts previously considered when determining whether to confine persons 18 years and older with delinquency petitions.

• Applies to minors arrested or taken into custody on or after January 1, 2014.
