HB5785 Summary

• Allows special districts and authorities to cease operations through majority board vote if annexing to a contiguous district, consolidating into a coterminous municipality, or consolidating into their county (single-county districts only).

• Requires the receiving governmental unit to accept the functions by resolution; upon effective date, all district assets, liabilities, bonding authority, taxing authority, and responsibilities transfer to the receiving unit.

• Applies to 11 types of districts and authorities: cemetery maintenance, civic center, public health, tuberculosis sanitarium, museum, international port, solid waste disposal, street light, surface water protection, water service, and water commission districts.

• Protects transferred employees by maintaining their status under existing contracts, collective bargaining agreements, representation rights under the Illinois Public Labor Relations Act, and pension or retirement plan benefits.

• Effective immediately upon passage.
