IL HB5922

Adds new criminal trespass offense for entering or remaining upon transit authority rights of way after receiving notice that entry is forbidden, when the person intends to compromise public safety by causing a transit delay exceeding 15 minutes or destroying property.

Defines notice as personal notification (oral or written) or conspicuously posted written notice at any point of entrance to the right of way.

Applies to rights of way owned, leased, or used by public bodies organized under the Metropolitan Transit Authority Act, Local Mass Transit District Act, or Regional Transportation Authority Act.

Establishes transit-related trespass as a Class A misdemeanor for first violation and a Class 4 felony for second or subsequent violations.

Preserves existing criminal trespass provisions for state-supported land, which remain Class A misdemeanors.
