• Amends Illinois health information privacy laws to align with HIPAA standards and facilitate electronic health information exchange through Health Information Exchanges (HIEs) while maintaining patient privacy protections.

• Allows covered entities to disclose HIV-related information and genetic information to HIEs and business associates without patient consent for treatment, payment, health care operations, and health oversight activities in compliance with HIPAA.

• Requires patients to receive meaningful disclosure about HIE participation at their first encounter for HIV-related care or genetic testing and provides opportunity to opt out of having their health information transmitted through an HIE.

• Establishes new definitions and disclosure standards for HIV-related and genetic information consistent with HIPAA, including provisions for de-identified information, limited data sets, research, and minimum necessary standard disclosures.

• Modifies Illinois Department of Corrections, Department of Juvenile Justice, and County Jail Act to require HIV testing and counseling information be provided to inmates, with option for opt-out testing in certain facilities, while maintaining confidentiality under the AIDS Confidentiality Act.
