HB5946 Summary

• Amends the Counties Code Section 5-25013 to change board of health authority regarding mental health and substance abuse programs from mandatory ("shall") to permissive ("may").

• Removes the requirement that boards of health establish and carry out programs and services in mental health, intellectual disabilities, and alcoholism and substance abuse.

• Relocates mental health program authority from Section 5-25013(A)(15) as a mandatory duty to Section 5-25013(B)(8) as an optional power that boards of health "may" exercise.

• Mental health, intellectual disabilities, and substance abuse programs remain subject to Department of Human Services regulations when boards choose to offer them.
