HB5991 Summary

• Expands the definition of "child" for child support purposes to include: children under 19 who were not attending high school at age 18 but have resumed attendance, and children under 22 attending high school while receiving special education services under an individualized education program (IEP).

• Establishes a rebuttable presumption that a child meets eligibility conditions for non-minor child support if receiving special education services under an IEP or receiving transition services from the Department of Human Services after previously receiving special education services.

• Amends the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/505 and 5/513) to extend child support obligations for children with disabilities and those still attending high school beyond traditional age limits.
