SB1186 Summary

• Amends the Mental Health and Developmental Disabilities Confidentiality Act to add definitions for "business associate," "covered entity," "health information exchange" (HIE), "integrated health system," and "interdisciplinary team" aligned with HIPAA standards.

• Permits HIEs, therapists, facilities, agencies, integrated health systems, and interdisciplinary teams to disclose recipient information without consent for treatment, care coordination, and HIE purposes, with recipients able to opt-out of further HIE disclosures.

• Allows disclosure of de-identified information and limited data sets without recipient consent when conducted in accordance with HIPAA requirements.

• Authorizes business associates and the Illinois Health Information Exchange Authority to use and disclose recipient records without consent for HIE purposes and record locator services.

• Prohibits disclosure or re-disclosure of recipient information through HIEs to law enforcement personnel or for law enforcement purposes.
