Lake County or McHenry County may assess a public safety enforcement user fee of up to $20 per user for recreational or commercial boating on Fox Waterway Agency waterways.

If both Lake County and McHenry County levy fees, the combined fee is $30, with 60% remitted to Lake County and 40% to McHenry County.

The Fox Waterway Agency collects the fees and may retain $0.50 per fee for administrative costs associated with collection and processing.

County public safety enforcement user fees are exempted from the requirement that at least 75% of gross income be used for waterway maintenance and improvement projects.

Fees collected must be used by the counties for law enforcement purposes.
