SB1368 Summary

• Amends Section 5-5.4 of the Illinois Public Aid Code to establish payment standards for nursing facility and ICF/DD services under the medical assistance program on a prospective basis using historical financial and statistical data.

• Requires rate increases effective July 1, 2013 for intermediate care facilities for developmentally disabled and long-term care facilities for residents under age 22 sufficient to provide a $1 per hour wage increase for direct care staff, front-line supervisors, nurses, and non-administrative support staff.

• Establishes MDS (Minimum Data Set) methodology for nursing component rate calculations effective July 1, 2003 with transition protections: facilities receiving lower rates are held harmless at previous levels until achieving higher reimbursement, while facilities receiving higher rates are adjusted accordingly.

• Allocates minimum $8,000,000 from facility assessment funds for enhanced payments to offset costs for exceptional needs residents (including ventilator care, bariatric care, complex wound care, and traumatic brain injury care).

• Suspends application of Section 5-5.4 methodologies for nursing facility services provided on or after January 1, 2014, pending federal approval of payment methodologies and assessment waivers.
