IL SB1399

Eliminates the statute of limitations for civil actions based on childhood sexual abuse, allowing cases to be commenced at any time.

Defines "childhood sexual abuse" as sexual abuse occurring when the person is under 18 years old, including sexual conduct and penetration as defined in the Criminal Code of 2012.

Establishes a 20-year discovery period beginning when the victim discovers (or reasonably should discover) both that the abuse occurred and that an injury was caused by the abuse.

Tolls the limitation period during times when the victim is subject to threats, intimidation, manipulation, or fraud perpetrated by the abuser or someone acting in the abuser's interest.

Applies to actions pending on the effective date of this amendatory act as well as actions commenced on or after that date, provided the action would not have been time-barred under prior law.
