SB1442 - No Representation Without Population Act

• Illinois Department of Corrections must collect and maintain electronic records for persons entering custody after January 1, 2014, including last known address before incarceration, race, Hispanic/Latino origin, and age.

• Department shall report incarcerated persons' data to Secretary of State by May 1 in years when federal decennial census is taken, using unique identifiers that do not reveal individual identities.

• Secretary of State shall prepare redistricting data that counts incarcerated persons at their legal residential addresses rather than at correctional facility locations for determining Legislative and Representative Districts.

• Data Collection and Reporting Advisory Council of 11 members appointed by Governor shall meet twice yearly to provide consultation on the data collection and reporting process.

• Secretary of State's redistricting data shall not be used for distributing State or federal aid, and persons with unknown residences shall not be counted toward determining ideal population for districts.
