IL SB1598

Requires collection of ethnic and racial background data for all arrested adults and juveniles at arrest/booking, Department of Corrections admission, Department of Juvenile Justice admission, and upon transfer from Juvenile Justice to Corrections.

Establishes six racial/ethnic categories for data collection: American Indian or Alaskan Native, Asian or Pacific Islander, Black or African American, White or Caucasian, Hispanic or Latino, and Unknown.

Mandates good-faith efforts to collect race and ethnicity information as self-reported by arrestees, with alternative procedures to deduce this information if individuals are unable or unwilling to provide it.

Requires all law enforcement agencies to report ethnic and racial background data daily to the Department of State Police along with fingerprints and descriptions for felony and Class A/B misdemeanor arrests.

Mandates inclusion of ethnic and racial data in master record files maintained by the Department of Corrections and Department of Juvenile Justice, and requires annual reporting of this data in aggregate form to the Governor and General Assembly.
