IL SB1643

Creates an exception to sex offense classification for consensual sexual conduct violations under Section 11-1.50(c) of the Criminal Code when the victim is at least 13 years old and the offender is no more than 4 years older.

Requires court to make factual findings that the sexual conduct was not coerced or obtained through undue influence and that the offender is not a risk of re-offending based on risk assessment, sex offender history, mental and social history, victim impact statements, and other relevant factors.

Expands the scope of certain provisions to include aggravated criminal sexual abuse under Section 11-1.60(d) in addition to violations under Section 11-1.50.
