SB1696 Summary: Prescription Drug Repository Program Act

• Establishes a prescription drug repository program administered by the Illinois Department of Public Health allowing healthcare facilities (assisted living, hospice, rehabilitation, long-term care) to donate unused prescription drugs and supplies to eligible individuals through participating pharmacies.

• Sets requirements for donated drugs including original sealed packaging, expiration date at least 6 months in the future, pharmacist inspection for adulteration or misbranding, and prescription from a licensed practitioner for eligible recipients.

• Prohibits resale of donated drugs and allows pharmacies to charge a handling fee to recipients; pharmacies may distribute donated drugs to other eligible pharmacies but participation is voluntary.

• Provides civil and criminal immunity for drug manufacturers and pharmacists involved in donating, accepting, or dispensing drugs under the program except in cases of willful and wanton misconduct.

• Amends multiple state pharmacy and drug control acts to exempt persons engaged in packaging, repackaging, or labeling prescription drugs under this program from regulations that would otherwise prohibit or restrict such activities.
