IL SB1704

Amends Section 9.1 of the Environmental Protection Act to incorporate federal Clean Air Act provisions (Sections 111, 112, 165, and 173) as enforceable state law, requiring compliance with federal standards for new stationary sources and hazardous air pollutants.

Establishes that no person shall construct, install, modify, or operate equipment or facilities subject to federal Clean Air Act regulation without obtaining required permits from the Agency and complying with all applicable permit conditions.

Adds Section 9.1(x) to allow State operating permit terms and conditions to remain in effect during renewal proceedings if a complete application is submitted before the permit expires, provided the permit contains federally enforceable conditions limiting emissions below major source thresholds.

Removes former Section 9.1(f) provisions requiring permits to remain in effect for 90 days after submission of a complete renewal application, replacing it with the new continuance-of-terms provision in subsection (x).

Takes effect upon becoming law.
