Paint Stewardship Program Act - SB1705

• Establishes a paint stewardship program requiring architectural paint manufacturers (producers) to form a representative nonprofit organization to manage collection, reuse, and recycling of post-consumer paint statewide by March 1, 2015.

• Requires producers to join the representative organization and submit a program plan to the Illinois Environmental Protection Agency detailing collection infrastructure, funding mechanisms, and environmentally sound management practices for paint disposal.

• Implements a uniform paint stewardship assessment added to the purchase price of all architectural paint sold in Illinois, with costs reviewed by an independent auditor to ensure the assessment does not exceed program maintenance costs.

• Mandates convenient statewide collection access with 90% of Illinois residents having a permanent collection site within 15 miles by road and additional sites based on population density (one per 30,000 residents in population centers).

• Prohibits producers, distributors, and retailers from selling architectural paint from non-participating manufacturers after the program implementation date; violations subject to civil penalties of $500 per day enforced by the Attorney General or State's Attorneys.
