SB1773 Summary

• Amends the Illinois Insurance Code to allow electronic delivery of insurance notices and documents, including policy forms, endorsements, and evidence of coverage.

• Permits insurers to deliver standard property and casualty policy documents without personally identifiable information electronically without affirmative consent, provided insureds can easily access, print, and save documents, and insurers archive expired policies for 5 years.

• Requires all other electronic delivery to obtain affirmative consent from the party, which can be withdrawn at any time with effectiveness within a reasonable period.

• Establishes that electronic delivery is equivalent to all traditional delivery methods required by law (first class mail, certified mail, etc.) and does not affect content or timing requirements.

• Provides that oral communications or recordings reliably stored by an insurer may qualify as electronic delivery, and electronic signatures satisfy notarization or verification requirements if properly attached to documents.
