Rental companies must obtain written agreement from renters before selling a damage waiver at or prior to executing the rental agreement.

Rental companies may only void a damage waiver for specific reasons including commercial use, racing activities, intentional criminal acts, auto business operations, fraudulent misrepresentation, use outside continental United States, unauthorized drivers, and DUI convictions.

Collision damage waiver charges are capped at $12.50 per full or partial 24-hour rental day prior to January 1, 2014, increasing to $13.50 beginning January 1, 2014.

Starting January 1, 2015, collision damage waiver charges increase annually on January 1 by the lesser of the Consumer Price Index for All Urban Consumers or 5%.
