Licensees subject to disciplinary action by the Department of Professional Regulation may apply to have disciplinary records classified as confidential and expunged for reporting purposes by paying a $200 non-refundable fee.

Applications are eligible only if submitted more than 7 years after the disciplinary offense, the licensee has had no subsequent discipline, there are no pending investigations, and the licensee is not currently in disciplinary status.

Confidentiality applies only to specific offense types including failure to pay taxes or student loans, continuing education violations, late license renewal, advertising violations, and grounds for discipline removed from the licensing Act.

The Department may use previous discipline records for regulatory purposes and may release records to law enforcement or other governmental bodies as permitted by law, and is not required to report removals to national databases.

Licensure records designated confidential under this Act are not reportable under the Health Care Professional Credentials Data Collection Act.
