IL SB1901

Creates the Consumer Reciprocal Attorney's Fees Act to allow defendants in consumer contract disputes to recover reasonable attorney's fees if they prevail in court, provided the contract allows for attorney's fees recovery.

Defines "consumer contract" as any contract where the money, property, or service is primarily for personal, family, or household purposes.

Applies only to actions filed after the effective date where the claimed amount does not exceed the maximum allowable small claim judgment under Illinois Supreme Court Rules.

Does not apply if the plaintiff fails to request attorney's fees in the complaint or if both parties were represented by counsel during contract negotiation.

Preserves all existing attorney's fees rights under other Illinois contracts and laws.
