SB1977 Amendment Summary

• Amends Section 5-1 of the School Code to allow Lyons Township High School District 204 to withdraw from township treasurer and school trustee jurisdiction by adopting a proper resolution and electing/appointing its own school treasurer.

• Upon withdrawal, township trustees lose all powers and duties over the district; all books, records, moneys, securities, and assets transfer to the school board; and legal title to school buildings and sites vests in the school board.

• Allows school boards in certain elementary, unit, and high school districts to withdraw from township authority through resolutions without requiring voter approval (applies to specified districts in Cook County including Oak Park, River Forest, Berwyn, Cicero, and Lyons townships).

• Establishes procedures for Class II county school units to abolish township treasurer and trustee offices through voter referendum, requiring notice, school board resolutions, and majority approval in each affected school district.

• Requires school districts assuming independent operations to pay proportionate shares of former township treasurer compensation and unfunded Illinois Municipal Retirement Fund liabilities, calculated based on average daily attendance ratios.
