IL SB2014

Amends the Illinois Governmental Ethics Act Section 3A-40 to establish time limits for appointees whose terms have expired or who serve in temporary or acting capacities requiring Senate advice and consent.

Appointees with expired terms may not continue in office longer than 60 calendar days after term expiration; after 60 days the office is considered vacant and must be filled pursuant to applicable law.

Temporary appointees must have the Governor file a nomination message with the Secretary of the Senate by the next Senate meeting or they cannot continue in office; perfunctory session days do not count as meetings.

Acting appointees cannot serve more than 60 calendar days unless the Governor nominates them within that period; the same person cannot be redesignated as an acting appointee for the same office during the same Senate session except at the Senate's request.

Adds new provision (c-5) specifying that refiling or superseding a previous nomination message does not restart the 60 session day confirmation or rejection period under the Illinois Constitution; provisions do not apply to Election Code appointments or the Director of the Illinois Power Agency.
