IL SB2085

Amends Section 40 of the Day and Temporary Labor Services Act regarding work restrictions for day and temporary laborers.

Prohibits day and temporary labor service agencies from restricting a laborer's right to accept permanent employment with a client or restricting clients from offering permanent positions to laborers.

Allows agencies to charge placement fees to clients hiring permanent employees, capped at the equivalent of 60 days of commission minus commission earned during the preceding 12 months of work by that laborer.

Exempts skilled labor placements from the placement fee cap, where "skilled labor" is defined as positions requiring advanced application processes, screening (including testing), and job interviews.

Prohibits placement fee collection when a laborer is offered permanent work following suspension or revocation of the agency's registration by the Department.
