IL SB2151

Amends the Illinois Public Aid Code Section 5-4 to make a technical change regarding the amount and nature of medical assistance provided under the state's public aid program.

Medical assistance amounts shall not be affected by payments from the Senior Citizens and Disabled Persons Property Tax Relief Act, certain distributions under the Illinois Income Tax Act, or donations/benefits from fundraisers for serious illness (when recipients have no control over disbursement).

Establishes community spouse resource allowance at the higher of $109,560 or the federal minimum, and monthly maintenance allowance at the higher of $2,739 per month or the federal minimum, whichever is greater.

Authorizes the Department of Healthcare and Family Services to seek spousal support from a community spouse for institutionalized spouses receiving medical assistance, with no limits on support amounts based on standard ability-to-pay regulations.

Allows the Department to establish support orders through circuit court or administrative procedures and to recover aid provided during periods when support was not obtained.
