IL SB2231

Amends criminal damage to property laws to elevate penalties for damage to property that memorializes or honors police officers, firefighters, members of the United States Armed Forces, National Guard, or veterans to the same level as damage to schools, places of worship, and farm equipment.

Damage not exceeding $300 to memorial property becomes a Class 4 felony (previously Class A misdemeanor), and damage exceeding $300 but not exceeding $10,000 becomes a Class 3 felony (previously Class 4 felony).

Damage exceeding $100,000 to memorial property becomes a Class 1 felony (previously Class 2 felony).

Makes identical enhancements to penalties for criminal defacement of property when the defaced property memorializes or honors police officers, firefighters, members of the United States Armed Forces, National Guard, or veterans.

All other provisions of criminal damage and defacement statutes remain unchanged, including community service requirements, fines, and affirmative defenses based on property owner consent.
