SB2239 Summary

• Amends the State Finance Act to limit outstanding liabilities from the State Employees Group Health Insurance Program that may be paid from future fiscal year appropriations to $1,500,000,000 for fiscal year 2013, $750,000,000 for fiscal year 2014, and $0 for fiscal year 2015 and thereafter.

• Establishes maximum aggregate amounts for all outstanding liabilities across multiple state programs (medical assistance, child care, tuition reimbursement, etc.) that may be paid without regard to fiscal year limitations: ranging from $6,000,000,000 for FY2012 down to $0 for FY2021 and beyond.

• Creates extended lapse periods allowing certain departments to pay outstanding bills after fiscal year end: 4-6 months for medical and child care payments, and 6 months for Department of Healthcare and Family Services Medical Assistance liabilities.

• Requires affected state departments to submit annual reports documenting expenditures from current fiscal year appropriations used to pay for services provided in prior fiscal years, submitted to the Comptroller and legislative leadership.

• Limits liability carryover for bills received after fiscal year end to only those claims incurred but not billed by September 30th following the fiscal year in which services were rendered.
