SB2307 Summary

• Amends the Workers' Compensation Act to define "accident" as an occurrence arising out of employment, resulting from a risk incidental to employment, and occurring at a time, place, and under circumstances reasonably required by the employment.

• Defines "injury" as a condition or impairment arising out of and in the course of employment that must be established to a reasonable degree of medical certainty based on objective medical findings, with the compensable injury being the major contributing cause (more than 50% responsible) of any resulting injuries.

• Specifies that "injury" includes aggravation of a pre-existing condition by a work accident, but only while the aggravation remains the major contributing cause of the disability.

• Excludes from compensation any injury resulting directly or indirectly from idiopathic causes (conditions arising from unknown or internal causes unrelated to employment).

• Requires that an injury must not come from a hazard or risk unrelated to employment to which employees would be equally exposed outside of work.
