IL SB2602

Amends the Illinois Public Aid Code regarding irrevocable trusts under the Aid to the Aged, Blind, or Disabled (AABD) program to expand the definition of guardians whose wards may receive post-age-65 trust funding without penalty.

After a person reaches age 65, any funding to an irrevocable trust is treated as a transfer of assets for less than fair market value unless the person is a ward of the court, a county public guardian, or the State Guardian and lives in the community.

Allows post-age-65 trust funding without penalty if the person is a ward of the court, a county public guardian, or the State Guardian and a court has found that trust expenditures will maintain or enhance the person's quality of life.

Changes the language to include "ward of the court" as an explicit category alongside county public guardians and the State Guardian (previously only referenced county public guardians and State Guardian).
