IL SB2650

Amends the Code of Criminal Procedure to require refunds of fines, fees, and court costs for defendants whose convictions are reversed based on a finding of factual innocence in collateral proceedings such as habeas corpus or post-conviction relief.

Exempts exonerated defendants from liability for court costs, circuit clerk fees, or subsistence charges while in custody.

Requires the clerk or judge to issue a certificate documenting all paid costs, fines, and fees, which shall be refunded to the defendant after audit and approval according to law.

Establishes a refund request process requiring defendants to submit applications to the court clerk on a prescribed form and attach a court order demonstrating their entitlement to the refund and the refund amount.
