IL SB2658

Amends the Illinois Highway Code to expand allowable uses of motor fuel tax funds allocated to municipalities to include treatment or removal of ash trees infected with emerald ash borer from public rights-of-way.

Permits municipalities to use motor fuel tax funds for ash tree treatment or removal only if the municipality is located within the emerald ash borer internal State quarantine zone established by the Illinois Department of Agriculture, or if the entire State has been declared infested and the quarantine rescinded.

Requires ash trees targeted for removal to be located on public rights-of-way or pose a potential hazard to vehicle travel, and must be documented in a detailed municipal inventory.

Prohibits use of motor fuel tax funds for planting replacement trees as part of ash tree removal projects.
