SB2789 - Earned Sick Time Act

• Requires all employers with 20 or more employees to provide paid sick time beginning January 1, 2015, and employers with 15 or more employees to provide unpaid sick time beginning January 1, 2016.

• Mandates a minimum of 1 hour of paid sick time for every 40 hours worked, with a minimum of 2 days per calendar year, accruing in 1-hour increments starting at employment commencement.

• Permits employees to use accrued paid sick time after 6 months of employment for their own illness or medical care, family member care, or closure of workplace/school due to public health emergency.

• Prohibits employer retaliation against employees for using sick time and requires employers to post notices in English and languages spoken by at least 5% of workforce regarding sick time rights and protections.

• Sets civil penalties of at least $500 per violation and allows employees to bring court actions within 3 years of violations, with potential damages, attorney's fees, and reinstatement available.
