Department of Human Services shall submit preliminary report by November 1, 2012 and final report by October 1, 2013 on the impact of Section 104-18(c) of the Code of Criminal Procedure regarding defendant fitness determinations.

Department shall prepare an additional report by January 2, 2016 on the impact of these provisions after January 1, 2014, and post all reports on its website within one week of submission.

Each report must address the number of admissions, delays in admissions, persons returned to county jail, and issues county sheriffs face with returns, including recommendations from the Department of Human Services and Illinois sheriffs' association on whether to continue the pilot study.

General Assembly may eliminate Section 104-18(c) prior to January 1, 2014 if either report indicates serious deleterious effects or inadequate results from the fitness determination provisions.

Removes the automatic expiration date of Section 104-18(c) originally set for January 1, 2014, allowing the provisions to remain operative pending the outcome of the reporting and review process.
