Eliminates the presumption that persons accused of sexual assault offenses (Sections 11-1.20, 11-1.30, 11-1.40, 11-1.50, or 11-1.60) cannot commit such crimes based on age, physical condition, or relationship to the victim.

Authorizes prosecuting State's Attorneys to seek court orders requiring accused persons to be tested for sexually transmissible diseases, including HIV, within 48 hours after probable cause is found, an indictment is returned, or an unfitness finding is made.

Requires HIV testing be performed by licensed medical practitioners using tests approved by the Illinois Department of Public Health, with positive results confirmed by supplemental testing per CDC recommendations.

Mandates test results be kept strictly confidential and personally delivered in sealed envelopes to the victim, defendant, State's Attorney, and judge; allows judge discretion on result disclosure while protecting victim identity.

Requires county payment for testing costs, with costs taxable against the accused if convicted, and mandates hospitals provide sexual assault survivors with information about controlled substances and offer voluntary testing for drug/alcohol ingestion.
