IL SB3101

Amends Section 33A-1 of the Criminal Code of 2012 to establish legislative findings that firearm use in felony offenses poses greater threat to public safety than other weapons and facilitates criminal activity more effectively.

Declares legislative intent to impose greater penalties when firearms are used or discharged during felony offenses compared to penalties for using other types of weapons, with penalties increasing based on offense severity.

Defines three categories of dangerous weapons: Category I includes handguns, sawed-off shotguns, semiautomatic firearms, and machine guns; Category II includes rifles, shotguns, stun guns, tasers, and knives with blades 3+ inches; Category III includes bludgeons, brass knuckles, and similar instruments.

Provides that if Public Act 88-680 is declared unconstitutional under Article 4, Section 8 of the Illinois Constitution, the amendments made by that Act to Article 33A are hereby reenacted.

Takes effect upon becoming law.
